The Truth, ALWAYS Prevails in the Private Administrative Process.
We know that ALL Commerce operates under FRAUD and FICTION. Everything is in your ALL CAP NAME which is a fiction. When our clients come to us with a conflict, be it debt, employment issues, irs issues, etc., the conflict is about the ALL CAP NAME, not YOU!
Here is a simple process if the truth of the matter is that their offer is fraud or fiction;
1. Prepare an Affidavit of Truth; make it factual....no emotions involved....state the facts.
2. File the Affidavit into the Public Record; I use www.getnotice.info.
3. Printout a true copy of the recorded Affidavit of Truth and attach it to a Notice and Demand and send to the opposing party....giving them conditions for a sufficient answer being that it MUST be signed by a real party representing that agency, swearing under penalty of perjury, with full and unlimited commercial liability, and give a deadline to receive response.
4. If you are telling the truth, they will NOT respond sufficiently as that would be committing perjury....when they do not respond, execute an Affidavit of Non Response and an Affidavit of Non Performance.
5. Prepare and Execute a Notice of Fault Opportunity to Cure and include Default Provisions [ie: their insufficient response constitutes their consent and agreement to granting you power of attorney, their confession to zero balance, their consent to a commercial lien against them for the financial injury they caused you in their dishonor, etc. .]
6. Prepare and Execute an Affidavit of Non Response and Non Performance for the Notice of Fault Opportunity to Cure.
7. Prepare and Execute a Notice of Default and Consent to Judgment.
8. Prepare and Execute an Estoppel Notice.
9. Record documents into the public record and then, with your tacit agreement for the power of attorney, one can fix the public record to zero balances, clear credit bureau issues, etc.
Lawyers, Bankers, Courts, Opposing Parties, ALL will go silent when you put the truth in front of them (or, they will attempt to trick you into a new contract through their deceptive measures)....when you make THEM personally liable for what they say [must be signed by a real party representing the agency/opposing party, swearing under penalty of perjury, with full commercial liability].
